The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. You do not acquire ownership rights to any content, document or other materials viewed through the Site. Fraud: By becoming a member, you confirm that the information provided in this form is true and that you agree to abide by the Terms and Conditions of use of this site. Please note that your membership can be cancelled without notice if it is determined that false or misleading information has been provided, the Terms and Conditions of use have been violated, or other abuses have occurred as determined by Des Kelly Interiors in its sole discretion. If membership has been revoked, Des Kelly Interiors reserves the right to refuse application or readmission to the membership program.

Limited Right to Use. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. Use of Information. We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. Payments. You represent and warrant that if you are purchasing something from us that (i) any credit card information you supply is true, correct and complete, (i) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any shipping fees and applicable taxes. All prices displayed are valid only online. In-store pricing may vary. All collections must be able to produce the card that the product was bought with and valid Photo ID.

This Site may include statements concerning our operations, prospects, strategies, financial condition, future economic performance and demand for our products or services, as well as our intentions, plans and objectives, that are forward-looking statements. These statements are based upon a number of assumptions and estimates which are subject to significant uncertainties, many of which are beyond our control. Submissions. All suggestions, ideas, notes, concepts and other information you may from time to time send to us (collectively, “Submissions”) shall be deemed and shall remain our sole property and shall not be subject to any obligation of confidence on our part. Without limiting the foregoing, we shall be deemed to own all known and hereafter existing rights of every kind and nature regarding the Submissions and shall be entitled to unrestricted use of the Submissions for any purpose, without compensation to the provider of the Submissions.

Return Policy. If you are unhappy with a product or products you have received, (in compliance with the Consumer Rights Act 2022) you will have 14 days to inform us of your intention to return the product from the day of its delivery, and an additional 14 days to return the product or products. However, if you wish to return an item to ourselves we ask that they are returned in their original packaging and are in perfect condition. Please note you will be responsible for any carriage costs incurred in the returning of goods. Refunds shall be given on receipt of the said goods once checked. Please note mattresses once opened can be returned, the act of opening any product will not affect your return or refund. However, the customer will be held liable for any damage of the goods incurred after it has been opened. Simply opening the packaging of your mattress will not constitute a restocking fee. Des Kelly Interiors accepts no responsibility for loss or damages caused during the delivery process. By allowing our employees or any representative of the company onto their premises the customer is accepting full responsibility without restriction for any loss or damage to their premises or their person. Specifically it is at your own risk that you permit our company representatives onto your premises.
Verify Members’ Address: Des Kelly Interiors reserves the right to contact a Member via email to verify the accuracy of account information (including the Member’s correct name and address) that is needed to provide the Member with the information he or she requested from Des Kelly Interiors.

Lapsed Accounts: In order to keep Des Kelly Interiors membership roster current, if a Member does not access his or her account for a period of 365 days or more, Des Kelly Interiors may, in its sole discretion, terminate such Member’s account. Des Kelly Interiors will endeavour to notify a Member of Des Kelly Interiors intent to terminate such Member’s account by notice to such Member’s provided email address at least 14 days prior to deactivation. If the Member fails to respond to such email notice within 14 days after the day it is sent by Des Kelly Interiors, such Member’s account will be terminated as noted above. Therefore, Des Kelly Interiors strongly recommends that all Members keep their accounts and contact data current and in use. While Des Kelly Interiors desires to prevent active accounts from being terminated prematurely, Des Kelly Interiors has no obligation to maintain accounts that appear to Des Kelly Interiors to have been abandoned. Each Member agrees that failure to access his or her account for 365 days or more conclusively indicates that such Member’s account has been abandoned and that the account may therefore be terminated.

Giveaway/Competition: All items used in a giveaway or competition are to be collected in a selected store or in our Ballycoolin warehouse in Dublin, No exceptions. An image must be taken of the winner for social media purposes. Strictly no cash refunds on gifted items. No items can be exchanged. Prizes are to be collected within 1 month after winner announcement date. By submitting their personal details, the entrant agrees to Des Kelly Interiors processing those details in accordance with the purposes made known the entrant at the time of collection and in accordance with Des Kelly Interiors privacy policy which can be viewed at https://old.deskelly.ie/terms-conditions. Any entrant who is entering the competition via e-mail may opt out of receiving any marketing communications from Des Kelly Interiors

Removal: We can only remove mattresses. If you choose the removal option please have the mattress ready. Black Friday Sale: Products marked as “Floor Model” must be inspected at the time of collection and sign for release. Please note “Floor Models” are tagged as sold as seen and there are no returns on these products.

Discount codes: Voucher/Promo codes are exclusive to our online store only.

Our email newsletter welcome discount is redeemable on our online store only.

All clearance items are sold as final sale. This means they are non-refundable, non-exchangeable, and cannot be returned under any circumstances

 

GIFTS CARDS TERMS & CONDITIONS

1. General Usage of Gift Cards:

• Gift cards are redeemable against eligible products on our website or in-store (depending on which was purchased). 
• Gift cards cannot be exchanged for cash and are non-refundable, except as required by law.
• Gift cards must be redeemed before their expiry.

2. Gift Card Redemption with Discount Codes:

• When a discount code is applied to an order, the total order value is adjusted before the gift card is applied.
• The cash value of the gift card will only be deducted from the final order total after the discount has been applied. Example: If you have a €50 gift card and apply a 10% discount code to a €100 order, the adjusted total (€90) will be reduced by the value of the gift card (€50). The remaining balance payable would be €40.

3. Restrictions:

• Gift cards cannot be used to cover shipping costs or additional charges unless otherwise stated.
• Only one discount code may be used per order, and it cannot be combined with other offers unless explicitly stated.
• Gift cards cannot be used to purchase other gift cards.

4. Transparency of Value:

• The value of the gift card and any discounts applied will be shown clearly at checkout.
• Customers are responsible for reviewing the final amount payable before completing their purchase.

5. Validity and Expiry:

• Gift cards issued by us are valid for 5 years from the date of issue, in accordance with Irish law under the Consumer Protection (Gift Vouchers) Act 2019.
• Any remaining balance after the expiry date will be forfeited.

6. Returns and Refunds:

• If you return an item purchased with a gift card and discount code, the refund will be processed according to the following:
• Discounted value will be refunded first.
• Any remaining balance will be re-applied to your gift card.

7. Legal Compliance:

• This policy complies with Irish consumer law, including the Consumer Protection Act 2007 and the Consumer Rights Act 2022.
• Any disputes regarding these terms will be governed by Irish law.
